Terms & Conditions

Client
You must ensure that prior to Quick Purchase Ltd contacting the client that you/your company have advised the client that you may receive a referral fee for referring their details to Quick Purchase Ltd. Quick Purchase Ltd will also ensure that they confirm this to the client upon contact.

Referral Acceptance
You will not be permitted to dispute any referral once it has been accepted in Quick Purchase Ltd online application. Any referral so accepted will, upon successful completion, be subject to the following referral commission:

Property Referral Commission = Total 1.5% or, if you are regulated to operate within the sale and rent back industry, and can provide a FRN number, the Property Referral Commission will increase by 0.5% totalling 2%

Note: These fees apply to Quick Purchase Ltd referrals only.

Referral Rejection
Referrals should only be rejected by Quick Purchase Ltd in the following situations:

a. The customer is known to Quick Purchase Ltd & that Quick Purchase Ltd has been involved in the valuation or negotiations of the subject property prior to the date of the referral.

b. The property to be valued & purchased is outside of the area in which Quick Purchase is active.

c. Prior to receiving the referral, an appointment has been made with the customer.

d. The customer is already on the Quick Purchase Ltd active mailing list/database.

e. The property or the client does not meet Quick Purchase Ltd require criteria

f. The customer has already been referred by another referee.

In all of these instances, Quick Purchase Ltd will be able to provide written evidence of their involvement with the customer, when required and asked to do so.

Right to withdraw from a transaction
Quick Purchase Ltd reserves the right to withdraw from a property transaction for any reason and at any time.

Referral Acknowledgement
ALL referrals will be acknowledged within 48 hours of receipt and will be updated on a regular basis.

Honouring Referrals
Quick Purchase Ltd will honour all referrals for a minimum period of 1 month (4 weeks). At the end of this period, the situation with the customer will be reviewed and, if still ongoing, the referral continued to be maintained within Quick Purchase Ltd online referral system.

Data Protection
All referrals should be properly qualified, setting clear expectations for the customer and ensuring that they provide their consent & agreement to be contacted by Quick Purchase Ltd. Quick Purchase Ltd warrants that at all times, the referee will comply fully with all laws and regulations applicable to the processing of any personal data under this Agreement and with the eight Data Protection Principles imposed by the Data Protection Act 1998.

Valid Referral Dates
All referrals created and saved within Quick Purchase Ltd online application will be deemed to be valid as from the automatic electronically generated date. This date is displayed on screen when viewing the referral.

Payment of Referral Fees
Following the successful completion of a referral, Quick Purchase Ltd will be liable to meet the referral fees due. The calculation of the fees payable by Quick Purchase Ltd must be based upon the actual completed sale price. Quick Purchase Ltd undertake to pay all referral fees due via a bank transfer or a cheque made payable to the referee at the address supplied within the Quick Purchase Ltd referral site.

After completion the referee must fax their 'Invoice' plus proof of ownership of the referral to Quick Purchase Ltd. (The e-mail confirmation which would have been received upon registering the referral online) Fax the ’Invoice’ to Quick Purchase Ltd on 01245 227920 as this is needed to validate the amount to be paid.

The invoice should be sent by you without being prompted by Quick Purchase Ltd and if after sending your invoice you have not received payment within 14 days, you will need to get in contact with your Quick Purchase personal representative.

Agents who initiate successful referrals will NOT be paid until they have submitted an original invoice to Quick Purchase Ltd.

Your Actions
Quick Purchase Ltd will not be held liable for your own actions throughout the entire process, nor will we bare any fees that you may incur.

E-mails
You must ensure that you keep all e-mail confirmation regarding your referral(s) to ensure that if there were any discrepancies that arose, in relation to the ownership of the referral, this can be proved and rectified immediately.

Resigning from Quick Purchase Ltd site
Where a member wishes to resign from the Quick Purchase Ltd referral site and currently has active referral(s) Quick Purchase Ltd will honour the referral fee providing an invoice is supplied upon completion of the transaction.

Changes to Terms and Conditions
If for any reason special terms are agreed between the referee and Quick Purchase Ltd you must ensure that you have any agreement/changes in writing.

This Web site is offered to you by Quick Purchase Ltd. Your use of this Web site and/or your acceptance without modification of the terms, conditions, and notices published on this Web site constitutes your agreement to all such terms, conditions, and notices. If you do not agree with these terms, conditions and notices, then you are not authorised to use this Web site.

The following are the terms, conditions and notices for use of this Web site including, without limitation, all other services which may be offered or provided from time to time by Quick Purchase Ltd.

Personal use limitation
This Web site is for personal use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services published on this Web site.

This agreement (and any disputes, claims or proceedings of whatever nature arising out of or in any way relating to the use of this Web) is governed by and shall be construed in accordance with the laws of England. You hereby consent to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the use of this Web site. Use of this Web site is unauthorised in any jurisdiction that does not give effect to all provisions of these terms, conditions and notices, including without limitation this Paragraph.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Quick Purchase Ltd as a result of this agreement or your use of this Web site.

Quick Purchase Ltd performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Quick Purchase Ltd right to comply with law enforcement requests or requirements relating to your use of this Web site or information provided to or gathered by Quick Purchase Ltd with respect to such use.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision(s) will be deemed superseded by a valid, enforceable provision(s) that most closely matches the intent of the original provision(s) and the remainder of the agreement shall continue in effect.

This agreement constitutes the entire agreement between you and Quick Purchase Ltd with respect to use of this Web site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Quick Purchase Ltd with respect to use of this Web site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Fictitious names of companies, products, people, characters, and/or data mentioned herein are not intended to represent any real individual, company, product, or event.
