repossession process court decisionWhen you return to court and the judge will make a decision based on all the information given. 

At this point you find out if you are about to lose your home or not.

There are 5 possible outcomes to the hearing:

• Adjourn (which means postpone)
• Strike (which means cancel)
• Agreement is reached to pay installments 
• You are given time to try and sell
• Eviction 

Possession order

If the judge decides in favor of the lender and you have to leave your property on the date which is stated by the judge. This is without a bailiff.

If you fail to vacate the property on the agreed date a ‘Warrant of Execution’ is applied enabling you to be removed by the courts bailiff.

Eviction Order

If you do not keep up payments that are arranged then the judge will have no alternative but to repossess the property, you will receive an eviction notice, generally giving you 14-28 days to vacate the property.

The judge will only be lenient in certain circumstances such as:

• Old age
• Very young children reside at the property
• If you are suffering from a terminal illness or you have a form of ill health

The courts bailiff will attend the property generally with the police and a lock smith and remove you from your property.
