Consequences if you fail to make payments under the terms of your CCJ  

If you still fail to make any form of payments, even under a CCJ, your creditor has three further options available to them. The creditor can apply, via the court, for:

Stage 1:- Attachment of Earnings Order – this is where the court grants the creditor payment from your earnings, before you get paid your wages.

Stage 2:- Charging Order – this is where your creditor is able to place a secured charge on your investment property or any assets you may have.

Stage 3: - Warrant of Execution – this is where the court grants a court appointed bailiff to attend your property and take possession of any goods (personal possessions) i.e. car, up to the value of the debt plus costs. The bailiff service is quite an expensive service!

Bailiffs are only used as a last resort.

You are not required to let bailiffs in, however, they can legally enter through any open door or window.

They can only legally break into your property if they have entered previously for that particular debt or they are recovering debts owed to the government i.e. VAT
